Fênix é a primeira pessoa reconhecidamente não-binária de Alagoas, ou seja, não se identifica como homem ou mulher. A imagem que Fênix via no espelho por muitos anos não condizia com os dados da sua documentação, e foi durante o mutirão da justiça que o desejo de mudar o nome e omitir o gênero na certidão de nascimento foi possível, segundo Notícias de Alagoas, Correio de Alagoas.

Fênix afirma que esse reconhecimento é uma maneira de existir socialmente. “Eu senti que depois dessa audiência consegui nascer. Existir como deveria ser, sem a imposição desse sistema cisgênero que determina quem é homem e quem é mulher. Tem um campo político de existir socialmente, de entrar nos espaços e não ter que em alguns momentos falar o nome social e depois ter que falar o nome morto que não seja oficializado”.

A juíza Emanuella Porangaba, coordenadora do projeto Justiça Itinerante destacou a relevância da sentença inédita no judiciário alagoano e afirma que servirá como base para futuros pedidos que venham a acontecer. “A Fênix foi a primeira, certamente não será a última pessoa que se enquadra nessa situação. O poder judiciário já deu o primeiro passo e está de portas abertas para acolher essas pretensões justas, dignas e que conferem ao cidadão a mais plena cidadania, que até então isso era mitigado”.

O coordenador do Núcleo de Práticas Jurídicas da Uninassau, Vitor Montenegro, explicou que a petição pelo pedido foi solicitada por ele, as advogadas orientadoras do núcleo e seis alunos da instituição de ensino superior. “É um caso novo, emblemático e que teve a participação de gente nova. O Tribunal de Justiça de Alagoas vem passando por um momento de muita humanização e mais esse passo dado com certeza gera dignidade das pessoas trans, das pessoas não binárias, porque todos merecem ser tratados com dignidade”.

Para Fênix, o processo de mudança de nome e gênero é uma promessa de renascimento e pertencimento. “Eu tive convicção ‘nossa, é isso’. Agora eu existo, não só como Fênix, mas como uma pessoa que não se identifica nesse sistema realmente de ser homem ou mulher. A maneira como eu falo: Fênix da Silva Leite não é com dúvida mais, agora é certeza, eu existo nesse mundo”.
